Detailed terms and conditions for subscription Smartavia

These terms and conditions come into force and are valid from February 7, 2022.

Terms and Definitions

Subscriber – the subscription holder – an authorized individual on the Smartavia website, aged 18 years or older, who has purchased a Smartavia Subscription and can use the package of benefits under this subscription when booking air transportation and additional services of the Carrier for themselves and their companions. The Subscriber is identified through authorization credentials in the Personal Account.

Companion – an individual for whom the subscription is valid and who may only use the package of benefits under this subscription together with the Subscriber when booking air transportation and additional services of the Carrier.

Carrier – Joint Stock Company "Smartavia Airlines".

Smartavia Website – the official website of the Carrier, publicly available on the Internet at the unique address https://flysmartavia.com/ and its subdomains.

Personal Account – a section of the Smartavia Website accessible after authorization, which contains information about the Subscriber and allows them to view and manage the functionality available to them on the Smartavia Website.

Flight Segment – a non-stop flight from the point of departure to the point of destination. In some cases, it includes an intermediate landing without a change of flight number. For example, a trip on the route Arkhangelsk – Moscow – Arkhangelsk consists of two flight segments.

Partners – companies cooperating with the Carrier, including airlines, agencies, advertisers, and other organizations.

Code-share Flight – a flight operated under a code-share agreement between two airlines, according to which one party (the marketing carrier) has the right to sell transportation under its own carrier code on a flight operated by the other party (the operating carrier). Each party enters the code-share flight into automated reservation systems under its own flight number.

Booking – information about the service booked on the Smartavia Website by a passenger, the payment, and the confirmation status.

Air Ticket (Electronic Ticket) – a record in the airline's database containing information about the passenger, the selected flight, date, and cost of the trip.

Abbreviations and Acronyms

EMD — Electronic Miscellaneous Document — an electronic multi-purpose document for various Carrier fees for additional services.

VAT – Value Added Tax.

1. General Terms of the Subscription

1.1. The Carrier undertakes to provide the Subscriber with the subscription they have purchased, allowing the use of the benefit package when booking air transportation and additional services of the Carrier, and the Subscriber undertakes to pay for the subscription.

1.2. The benefit package under the subscription can only be used when booking air transportation and additional services on scheduled flights operated by the Carrier.

1.3. When booking air transportation on partner airlines' flights, including code-share flights, the benefit package under the subscription does not apply.

1.4. The Subscriber may use the benefit package under the subscription either individually or together with their Companion(s) when booking air transportation/additional services in their own name on the Smartavia Website. Companion(s) may only use the benefit package together with the Subscriber, meaning that when booking air transportation, the Subscriber and Companion(s) must be in the same booking. The Subscriber and Companion(s) are not entitled to transfer their benefit package under the subscription to third parties. Persons who are not the Subscriber or a Companion cannot be booked in the same reservation as the Subscriber or Companion.

1.5. When booking air transportation and additional services at sales offices and/or through the Carrier's call center, the benefit package under the subscription does not apply.

1.6. The subscription includes the following package of benefits:

  • A discount on air tickets of up to 200 rubles per flight segment when searching and booking a ticket on the Smartavia Website (the number of flight segments is limited and depends on the subscription plan). The discount is applied to all brand fares, except promotional and subsidized ones. The discount is not available on flights 5Н3307, 5Н3308, 5Н3103, 5Н3104.
  • A discount on the "Extra Baggage" service from 11 to 23 kg of up to 300 rubles from the current service rate when purchased on the Smartavia Website (the number of flight segments is limited and depends on the subscription plan). Restrictions apply.
  • Early access to sales on the Smartavia Website (when such sales occur during the subscription period).
  • Exclusive access to private promotions on the Smartavia Website (when such promotions occur during the subscription period).
  • Exclusive "By Subscription" fare available on selected routes of the Carrier's network.
  • A dedicated priority line to the Carrier's call center.
  • Special offers from the Carrier's partners.

1.7. The subscription period is 1 (one) year, starting from the date of payment for the subscription and expiring on the corresponding month and day of the calendar year following the subscription payment date.

1.8. Automatic renewal of the subscription is not performed. The subscription for the Subscriber terminates on the day following the last day of the paid period. Accordingly, no automatic debit of funds from the Subscriber's personal account occurs at the end of the subscription period.

1.9. By purchasing the subscription, the Subscriber:

  • guarantees the accuracy, completeness, and reliability of the personal information provided during authorization in the Personal Account on the Smartavia Website, when purchasing and using the subscription. The Subscriber bears sole responsibility and assumes all possible risks associated with the breach of this warranty;
  • agrees that they are solely responsible for the confidentiality of information about the Booking (EMD number, booking number) provided to the passenger by the Carrier after purchasing the service, and assumes responsibility for the negative consequences caused by disclosing this information to third parties, except in cases where such disclosure occurred due to the Carrier's fault.
  • confirms that they have read these terms and conditions and understand them.

2. Payment and Cost of the Subscription

2.1. The subscription is paid, the cost is determined by the Carrier and published on the Smartavia Website, as well as in clause 2.7 of these terms and conditions.

2.2. Payment for the subscription can only be made by monetary funds.

2.3. Payment for the subscription is made by the Subscriber via non-cash payment on the Smartavia Website.

2.4. Holders of the "Unified Card of a St. Petersburg Resident" can pay for the subscription with a 20% discount from any current rate. To apply the discount, during the subscription purchase process, you must enter the Unified Card of a St. Petersburg Resident identifier, located on the back of the card, in the appropriate field. The cardholder and the Subscriber must be the same person. At the time of purchasing the subscription, the Unified Card of a St. Petersburg Resident must be valid.

2.5. In case of transaction cancellation by the Subscriber through their bank's services or otherwise, regardless of the reason, access to the subscription is suspended until the Carrier receives full payment. Access to the subscription is suspended until the funds are actually credited to the Carrier's account.

2.6. If, during the subscription period, the maximum number of guaranteed discounts for the Subscriber/Companion(s) under the subscription has been used, the Subscriber cannot on their own initiative purchase the subscription again in the current period. The possibility of purchasing a new subscription begins on the day following the last day of the paid period.

2.7. At the end of the subscription period, no automatic debit of funds from the Subscriber's personal account is made.

2.8. When purchasing a subscription, the Subscriber is offered a choice of one of the current plans: "1+0", "1+1":

The subscription cost includes VAT.

3. Subscription Purchase and Procedure

3.1 To purchase a subscription, you must log in to the Smartavia website: register or log in to your Personal Account.

3.2 After purchasing and paying for the subscription on the Smartavia website, the Carrier sends a confirmation email and a payment receipt to the email address specified in the Personal Account.

3.3 To purchase air transportation/additional services with a discount under the subscription benefit package, the Subscriber must log in to the Smartavia website. After that, the subscription is activated, and all the Subscriber's personal offers are marked with a special icon Smartavia Subscription. Payment for air transportation/additional services can only be made by monetary funds; Voucher cannot be applied.

3.4 Air transportation and additional services included in the subscription are provided in accordance with the Carrier's rules for fares and services. Before booking tickets and additional services, the Subscriber must familiarize themselves with the rules for their provision.

3.5 The Subscriber receives information about early access to sales and other private promotions of the Carrier via email newsletters to the email address specified in the Personal Account.

3.6 The fact of providing the Smartavia Subscription is the Subscriber's ability to apply the entire package of benefits when booking air transportation and additional services of the Carrier on the Smartavia Website.

4. Re-issuance and Refund

4.1 Re-issuance of the subscription is not permitted.

4.2 Refund of the subscription cost is not permitted.

4.3 In case of voluntary changes to the air transportation conditions (date, time of departure, or route) initiated by the passenger, the applied guaranteed discount is not transferred to the new transportation conditions.

4.4 In case of involuntary changes to the air carriage contract, the applied guaranteed discount is automatically transferred to the new transportation conditions.

4.5 In case of voluntary refusal by the passenger of air transportation/additional services under the subscription, the service is considered rendered.

4.6 If the Subscriber does not use the benefit package when booking the Carrier's air transportation/additional services during the validity period, the subscription is considered provided and its cost is non-refundable.

5. Changes to Subscription Rules

5.1. The Carrier has the right to unilaterally make changes to these subscription terms and conditions.

5.2. The Carrier has the right to unilaterally change the amount of any established rates for purchasing the subscription. The newly established rate does not increase the cost of the subscription period already paid by the Subscriber but applies to all subsequent periods.

5.3. All changes regarding the subscription are made by publishing the corresponding adjustments to these subscription terms and conditions and updating the functionality of the Smartavia Website. Any changes come into force from the date of their publication (update), unless expressly provided otherwise. The Subscriber is obliged to independently monitor any changes to the terms and conditions and current information about the subscription status.

5.4. Changing the subscription terms is not grounds for canceling the subscription, revising the subscription cost, revising the duration of the subscription period, or refunding money to the Subscriber.

6. Other Provisions

6.1 The invalidity of one or more provisions of these terms and conditions, regardless of the reason for such invalidity, does not mean that other provisions of these terms and conditions are not legally binding.

6.2 The Carrier has the right to deny the passenger access to the subscription or cancel the subscription, including in cases of abuse of right or if the passenger purchases the subscription with agent functionality. Upon denial of access or cancellation of the subscription, the passenger loses the right to participate in the subscription.
